How is Paternity Legally Established in Chicago?

In Illinois, there are generally three ways to establish paternity for unmarried parents:

  1. Voluntary Acknowledgment of Paternity (VAP): This is the most common method. Both parents sign a VAP form, often at the hospital immediately after the child’s birth. This form carries the full weight of a court judgment.  A birth certificate does not suffice.
  2. Administrative Paternity Order: The Illinois Department of Healthcare and Family Services (HFS) can establish paternity administratively, often as part of a process to establish child support. While effective for support, this does not address parenting time or decision-making.
  3. Judicial Paternity Order: If paternity is contested or if a VAP was never signed, either parent can file a petition in court. The court may order DNA testing to determine biological fatherhood definitively. Once proven, the judge issues an order of paternity.

What Are the Rights and Responsibilities of Established Paternity?

Once paternity is established, both parents legally share the responsibility for the child. However, establishing paternity does not automatically result in a schedule for seeing the child or the authority to make decisions. Those issues must be addressed separately through an Allocation of Parental Responsibility.

  • Allocation of Parental Responsibility: This includes two components: parenting time (the schedule the child spends with each parent) and decision-making (authority over major choices like education, religion, and healthcare). A father must petition the court for an allocation judgment to secure these rights formally.
  • Child Support: Illinois uses an income shares model to calculate child support. This model considers the net income of both parents and the amount of parenting time exercised by each to determine a fair support obligation. Paternity establishes the legal duty to provide this financial support.
